User Agreement
The following User Agreement (“Agreement”) governs the use of the USA Legal Opinion web site (“Service”), as provided by USA Legal Opinion and advertised on by attorneys (“Subscribing Attorney”). Please read this Agreement carefully. You can access this Agreement at any time by clicking on “User Agreement” at the top of the home page. If you cannot agree to this user agreement, please do not use the Service. These terms may be modified from time to time. Continued use of the Service by you will constitute your acceptance of any changes or revisions to the Agreement.
In no event shall USA Legal Opinion be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of the Service, even if USA Legal Opinion has been advised of the possibility thereof.
By accepting this Agreement, you understand and agree that USA Legal Opinion may distribute your personal information, which you enter into data fields on the Service, to one or more Subscribing Attorneys who advertise their services on the Service. To protect your privacy, you should not provide the Service with any information that you do not want shared with the Subscribing Attorneys to whom your personal information may be sent.
1. Modifications
a. USA Legal Opinion reserves the right to make changes to any information contained within the Services pages and to make improvements and/or changes to the Service at any time and without notice.
2. Proprietary Rights
a. The Service contains materials that are owned by USA Legal Opinion, including without limitation, logos, text, software, photos, videos, graphics, music, sound, and the Service’s “look and feel” which are protected by copyrights, trademarks, service marks, patents, or other intellectual property laws. Unless expressly authorized by USA Legal Opinion, you may not copy, reproduce, transmit, distribute, sell, modify or create derivative works of such materials.
3. Indemnification
a. You agree to indemnify and hold USA Legal Opinion (including all affiliated companies, directors, officers, and employees) harmless from any loss, claim, demand, liability, damage, including attorneys fees and costs, made by any third party, including a Subscribing Attorney, relating to or arising out of:
i. Your use of the Service that is contrary to the provisions contained on the website
ii. Your breach of the User Agreement
iii. Disputes, interactions, or transactions between you and a Subscribing Attorney
4. Waiver and Release
a. You agree to waive and release any loss, claim, demand, liability, or damage against USA Legal Opinion (including all affiliated companies, directors, officers, and employees) relating to or arising out of your use of the Service or any interaction with a Subscribing Attorney.
5. Disclaimer of Warranties
a. The Service is provided on an “as is, available” basis. USA Legal Opinion does not make any warranties, express or implied, with respect to the Service, including without limitation, those of merchantability, fitness for a particular purpose and non-infringement. USA Legal Opinion makes no warranty, including, without limitation:
i. that an attorney accessed from the Service is licensed in the appropriate jurisdiction
ii. regarding the quality of the legal services obtained from an attorney accessed from the Service
iii. that the Service will operate error-free; and
iv. that all information obtained from the Service is accurate
6. General Provisions
a. This Agreement is governed by and shall be construed under the laws of the State of Texas, without regard to conflicts of law provisions. The parties agree that the state and federal courts sitting in Texas will have exclusive jurisdiction over any claim arising out of this Agreement or the Service, and each party consents to the exclusive jurisdiction of such courts. Should any provision of this Agreement be held void, invalid, unenforceable or illegal by a court of law, the remaining provisions will remain valid and enforceable. Failure to enforce any provision of this Agreement will not constitute or be construed as a waiver of such provision or of the right to enforce such provision. The headings and captions contained in this Agreement are inserted for convenience only and do not constitute a part of this Agreement.
USA Legal Opinion Disclosures/Disclaimers
USA Legal Opinion is a PAID ADVERTISEMENT. USA Legal Opinion is not a lawyer referral service, pre-paid legal plan, legal services organization or advertising cooperative. USA Legal Opinion is not endorsed, approved or recommended by any State bar association. Attorneys pay a fee to have USA Legal Opinion provide their contact information to you when you submit a legal question.
The list of attorneys that appears on the screen in response to your submission of an inquiry does not identify every attorney authorized to practice law in the practice area or zip code you select.
USA Legal Opinion limits the number of attorneys who will appear on the screen in response to your submission of an inquiry. The limits are based on practice area and geographic area. USA Legal Opinion sells only five (5) listings per each practice area and zip code.
USA Legal Opinion does not review or analyze the information you submit to the website. USA Legal Opinion automatically identifies attorneys that meet your objective search criteria and provides you with the names of the attorneys who have purchased the rights to answer questions submitted with a particular search criteria. USA Legal Opinion does not attempt to identify an attorney that is particularly skilled to handle your legal issue.
The decision to hire or engage the services of an attorney should not be based only on the information contained in this advertisement. Any decision regarding which attorney to engage should be based on an independent investigation of all facts and circumstances that you deem relevant in making the decision.
You are not required to retain an attorney that responds to your inquiry submitted to USA Legal Opinion. USA Legal Opinion will never refer you to a specific attorney or service. You have complete discretion in deciding which attorney to retain, if any. Your selection of an attorney shall be your sole responsibility, and USA Legal Opinion shall not have any liability related to your selection. It is entirely your responsibility to make sure that the terms on which you engage an attorney listed in USA Legal Opinion are acceptable to you. USA Legal Opinion shall not share in any legal fees paid or payable by you to a listed attorney.
You shall utilize USA Legal Opinion at your own risk. USA Legal Opinion makes no representation regarding the attorneys who respond to your legal inquiry. USA Legal Opinion does not guarantee the likelihood that you will find an attorney through USA Legal Opinion.
USA Legal Opinion makes no promise, warranty or other guarantee about the completeness, accuracy or truthfulness of the attorney information contained on USA Legal Opinion. The information on USA Legal Opinion, including, but not limited to, each listed attorney’s contact information and areas of practice, is provided and based on representations by, and is the responsibility of, the attorney. At the time an attorney submits an application to be listed in the USA Legal Opinion, the attorney must represent that he or she is a member in good standing in the state(s) in which he or she is admitted. USA Legal Opinion does not verify the attorneys’ representations.
USA Legal Opinion does not recommend or endorse any listed attorney and/or the services he or she provides. USA Legal Opinion also does not guarantee or make any representations regarding the competence, the integrity, honesty or trustworthiness of, the qualifications of, the quality of advice provided by, or the ability or suitability of, any attorney.

State Specific Disclosures
Alabama: No representation is made that the quality of the legal services to be performed is greater than the quality of legal services performed by other lawyers.
Alaska: The Alaska Bar Association does not accredit or endorse certifying organizations.
Connecticut: USA Legal Opinion does not recommend the attorneys listed. The attorneys are not listed based on their expertise, but rather that it offers the listing service only to attorneys who have subscribed and paid a fee to be included in USA Legal Opinion.
Delaware: The listing of areas of practice does not represent official certification as a specialist in those areas.
Florida: The hiring of a lawyer is an important decision. Before you decide to hire the lawyer, ask that lawyer for written information about that lawyer’s qualifications and experience. A Florida lawyer will furnish to a potential client upon request: (1) a factual statement detailing the background, training, and experience of each lawyer or the law firm; and (2) written information setting forth the factual details of the lawyer’s experience, expertise, background, and training in such matters if the lawyer limits his or her practice to special types of cases or clients.
Kentucky: COURT COSTS AND CASE EXPENSES WILL BE THE RESPONSIBILITY OF THE CLIENT.
Illinois: The Supreme Court of Illinois does not recognize certifications of specialties in the practice of law and a certificate, award or recognition is not a requirement to the practice of law in Illinois.
Iowa: The determination of the need for legal services and the choice of a lawyer are extremely important decisions and should not be based solely upon advertisements or self-proclaimed expertise. This disclosure is required by the Supreme Court of Iowa.
Memberships and offices in legal fraternities and legal societies, technical and professional licenses, and memberships in scientific, technical and professional associations and societies of law or field of practice do not mean that a lawyer is a specialist or expert in a field of law, nor do they mean that such a lawyer is necessarily any more expert or competent than any other lawyer.
A description or indication of limitation of practice does not mean that any agency or board has certified such lawyer as a specialist or expert in an indicated field of law practice, nor does it mean that such lawyer is necessarily any more expert or competent than any other lawyer.
All potential clients are urged to make their own independent investigation and evaluation of any lawyer being considered. This notice is required by the Supreme Court of Iowa.
Kansas: Any attorney listings or other information pertaining to a particular attorney or law firm on this site constitutes a paid attorney advertisement, and do not in any way constitute a referral or endorsement by an approved or authorized lawyer referral service.
Massachusetts: If a Massachusetts lawyer holds himself or herself out as “certified” in a particular service, field or area of law by a non-governmental body, the certifying organization is a private organization, whose standards for certification are not regulated by the Commonwealth of Massachusetts.
Mississippi: Attorneys should provide free background information upon request. Background information includes a factual statement detailing the background, training and experience of each lawyer or law firm. If the lawyer or law firm claims special expertise in the representation of clients in special matters or limits the lawyer’s or law firm’s practice to special types of cases or clients, the written information shall set forth the factual details of the lawyer’s experience, expertise, background, and training in such matters.
Missouri: The choice of a lawyer is an important decision and should not be based solely upon advertisements. Neither the Supreme Court of Missouri nor the Missouri Bar reviews or approves certifying organizations or specialist designations.
Nebraska: The listings of lawyers and law firms under the categorized areas of practice are not representations that those listed are specialists or certified in those areas of practice.
Nevada: A lawyer must have available in written form for delivery to any potential client a factual statement detailing his or her background, training and experience. The form must contain the lawyer’s full name and business address; date and jurisdiction for initial admission to practice; date and jurisdiction of each subsequent admission to practice; and name of law school and year of graduation. Anyone considering a lawyer should independently investigate the lawyer’s credentials and ability.
New Jersey: ATTORNEY ADVERTISEMENT NOT A LAWYER REFERRAL SERVICE. All attorney listings are a paid attorney advertisement, and do not in any way constitute a referral or endorsement by an approved or authorized lawyer referral service. Any certification as a specialist, or any certification in a field of practice, that does not state that such certification has been granted by the Supreme Court of New Jersey or by an organization that has been approved by the American Bar Association, indicates that the certifying organization has not been approved, or has been denied approval, by the Supreme Court of New Jersey and the American Bar Association.
New Mexico: Any certification by an organization other than the New Mexico Board of Legal Specialization does not constitute recognition by the New Mexico Board of Legal Specialization, unless the lawyer is also recognized by the board as a specialist in that area of law.
New York: Each lawyer must have available a written statement describing the scope of each advertised service and deliver the same to a client at the time he or she is retained to provide such service.
Oklahoma: This is an advertisement.
Rhode Island: The Rhode Island Supreme Court licenses all lawyers in the general practice of law. The court does not license or certify any lawyer as an expert or specialist in that area of law.
South Dakota: The fixed fees identified for specific legal services will be available only to a client seeking the specific services described.
Tennessee: Unless otherwise indicated, Tennessee attorneys are not certified as specialists by the Tennessee Commission on Continuing Legal Education and Specialization in the areas of practice listed in USA Legal Opinion.
Texas: Unless otherwise indicated, the attorneys licensed in Texas are not certified by the Texas Board of Legal Specialization.
Washington: The Supreme Court of Washington does not recognize certification of specialties in the practice of law. Any certificate, award or recognition by a group, organization or association used by a Washington attorney to describe his or her practice or qualifications as a lawyer or in any sub-specialty of law is not a requirement to practice law in the State of Washington.
Wyoming: The Wyoming State Bar does not certify any lawyer as a specialist or expert. Anyone considering a lawyer should independently investigate the lawyer’s credentials and ability, and not rely upon advertisements or self-proclaimed expertise.
